These Terms and Conditions of Use of the Online Store are intended to establish the terms and conditions governing the provision of travel services organised by Direct Book, Agência de Viagens, Lda., an entity with headquarters at Rua de Santo António 58, 3830-153 Ílhavo, registered at the Aveiro Commercial Registry Office, with the unique registration and legal entity number 510400078, with a share capital of 4,500 euros, registered in the National Register of Travel and Tourism Agencies (RNAVT) under no. 3608, in addition to any Special Conditions agreed between the Customer and Direct Book, Agência de Viagens, Lda.

The terms contained in the Special Conditions, if any, prevail over the provisions of these General Conditions, prevailing over any additional written stipulations specially agreed between the Customer and Direct Book, Agência de Viagens, Lda.

The services and products are offered to the Customer under the terms and conditions expressed in this document.

By contracting with Direct Book, Agência de Viagens, Lda., the Customer acknowledges and accepts all the terms and conditions set out herein.

The economic activity code of Direct Book, Agência de Viagens, Lda. is, among others, 79110 - Travel Agency Activities.

These general conditions comply with the provisions of Decree-Law No. 17/2018 of 8 March.

At the time of booking, the customer must pay a deposit, the amount of which will be communicated at the time of booking. The remaining balance must be paid within the period defined by Direct Book, Agência de Viagens, Lda., which may vary depending on the trip and the suppliers involved.

If the registration occurs shortly before the departure date, full payment may be required immediately after booking. All bookings are subject to availability and confirmation from our suppliers. Direct Book, Agência de Viagens, Lda. reserves the right to cancel any registration for which payment has not been completed in accordance with the terms communicated.

Transfer of registration

The customer may transfer their registration to another person who meets all the conditions required for the respective trip, provided that they inform the selling agency at least 21 days in advance and on condition that the airline or other suppliers accept the name change (Change Name). The transfer of the registration makes the transferor and the transferee jointly and severally liable for the payment of the price of the trip and any additional charges incurred.

Documentation

The Traveller must possess and keep in good order all personal or family documentation necessary for the trip, whether for leaving the country, entering the destination, or for any stopover planned in the itinerary. This documentation includes, and depending on each specific travel requirement, a Citizen Card, Identity Card, Passport, military documentation, authorisation for minors, visas, vaccination certificates and others that may be required. Direct Book, Agência de Viagens, Lda. declines any responsibility for the refusal to grant visas or the non-permission of entry of the Traveller into a foreign country, and the Traveller shall be responsible for any and all costs that such a situation may entail.

The issuance of travel documents (airline tickets and service vouchers) is subject to contractual conditions for group travel, and therefore cannot be issued well in advance of the departure date. However, issuance may have to be brought forward due to exceptional conditions imposed by suppliers.

Travel in the European Union

Travellers within the European Union must carry their civil identification document (Citizen Card, Identity Card, Passport or other required document). To obtain medical assistance in a foreign country within the European Union, you must carry a European Health Insurance Card.

Nationals of non-EU countries should consult specific information regarding the documentation required for travel at the embassies or consulates of their respective countries of origin.

Travel outside the European Union

Travellers travelling outside the European Union must be in possession of the relevant civil identification document, in this case a passport, as well as a visa if necessary. Direct Book, Agência de Viagens, Lda. can assist with this step.

Citizens of non-EU countries should consult specific information regarding the documentation required for travel at the embassies or consulates of their respective countries of origin.

After the airline ticket has been issued, the customer is subject to the conditions of both the chosen airline and the selected fare, which may restrict changes to the date or cancellation of the trip. Changes to the destination and/or passenger names are subject to the airline's rules and applicable transport regulations, including the application of penalties. Book does not accept any errors or changes after the airline tickets have been delivered and checked by the customer.

Changes requested by the traveler

Please note that cancellations must be made during the following hours: Monday to Friday from 9:30 a.m. to 6:30 p.m. Any cancellation requests outside these hours or on public holidays will be considered effective from the following working day, and the corresponding cancellation fees will apply. If you wish to modify your booking, please consult the conditions. Administration fees are non-refundable. Non-refundable rates do not allow for any type of modification.

Changes to be made by the agency

Whenever there are justified reasons for doing so, Direct Book, Agência de Viagens, Lda. may change the conditions set out in the programme, namely the order of the routes, departure times or replace any of the planned accommodation with others of a similar category and location, and must inform the customer of such changes.

If unforeseen circumstances force the trip to be cancelled, the customer will always be entitled to a refund of the amounts paid.

Price change

Direct Book, Agência de Viagens, Lda. reserves the right, up to 20 days before the date of travel, to change the price of the trip due to variations in the cost of transport or fuel, duties, taxes or fees chargeable, or exchange rate fluctuations, communicating this fact to the customer. The change will be calculated in proportion to the variation in the prices of the factors influencing the change.

Non-acceptance of the increase in the price of the trip, in accordance with the law, gives the customer the right to cancel their registration under the same terms and conditions set out in ‘Changes requested by the traveller’.

After the start of the trip, no refunds are due for services not used by the customer for reasons of force majeure or for reasons attributable to the customer, unless there is a refund from the suppliers. The non-provision of services for reasons not attributable to Direct Book, Agência de Viagens, Lda., if it is not possible to replace them with other equivalent services, entitles the customer to a refund of the difference between the price of the services provided and those actually provided.

The liability of the travel agency organising this programme and arising from the obligations assumed is guaranteed by civil liability insurance with Zurich - Companhia de Seguros S.A., policy no. 009530354, in the amount of €75,000.00, in accordance with the legislation in force.

The www.bookviagens.pt website offers the following payment methods:

1. ATM;

2. Credit card (VISA/Mastercard);

3. MB Way.

The payment methods are indicated according to the type of service booked and, in some situations, may not allow the use of all the payment methods indicated above.

Please ensure that you have provided your credit card details correctly. If this is not the case, your booking may be delayed and the total costs may be changed due to the late completion of the booking. In case of suspected fraud involving the use of credit cards for payment, Direct Book, Agência de Viagens, Lda. may request a copy of the card used and a copy of your ID. If fraud is confirmed, the services will be automatically cancelled regardless of whether the travel documents have been issued or the trip and/or stay has already begun.

Travel documents are issued after full payment and verification of successful collection. Direct Book, Agência de Viagens, Lda. reserves the right to cancel reservations that have not been paid within the specified time limits or in case of suspected fraud.

It is highly recommended that customers keep their booking confirmation, which includes all the trip details. In the case of airline tickets, it is possible to pay for the booking with a credit card that is not held by one of the passengers on the booking. However, additional security procedures may be required, such as sending a copy of the cardholder's ID. Some companies have made this practice standard in all cases where the cardholder is not one of the passengers on the trip. In turn, it has also been the practice of some companies to request that the credit card used to make the payment be shown at the time of boarding, even if it belongs to the person who made the booking, and boarding may be denied if the document is not presented.

The prices mentioned and displayed on www.bookviagens.pt already reflect the value added tax (VAT) at the legal rate in force in Portugal.

Any claim may only be considered provided that it is presented in writing and within a period not exceeding 20 days after the end of the provision of services. It can only be accepted provided that it has been reported to the service providers (carriers, hotels, local agents, etc.) during the course of the trip or stay, requiring them to provide the respective documents proving the occurrence.

Direct Book, Agência de Viagens, Lda. reserves the right to, at any time, make modifications or updates to these Terms and Conditions of use of the Online Store, and these changes will be duly updated on our platforms and websites.
