The combination of travel services offered to you constitutes a package tour within the meaning of current legislation. Therefore, you will benefit from all EU rights applicable to package tours. Direct Book - Agência de Viagens, Lda. is fully responsible for the proper execution of the entire package tour. In addition, as required by law, Direct Book - Agência de Viagens, Lda. has protection to refund any payments you have made and, if transport is included in the package tour, to ensure your repatriation in the event of insolvency. Essential rights provided for in Decree-Law No. 17/2018 of 8 March:
- Travellers will receive all essential information about the package tour before signing the contract;
- There is always at least one operator responsible for the proper performance of all travel services included in the contract;
- Travellers have an emergency telephone number or contact details for a contact point so that they can communicate with the organiser or travel agency;
- Travellers may transfer the package to another person, subject to reasonable notice and, where applicable, the payment of additional costs;
- The price of the package may only be increased in the event of specific cost increases (e.g. fuel prices), if this possibility is expressly provided for in the contract and, in any case, no later than 20 days before the start of the package. If the price increase exceeds 8% of the price of the package, the traveller may terminate the contract. If the organiser reserves the right to increase the price, the traveller is entitled to a price reduction in the event of a reduction in the relevant costs;
- Travellers may terminate the contract without paying a termination fee and obtain a full refund of payments made in the event of a significant change to any of the essential elements of the package, with the exception of the price. If, before the start of the package, the operator responsible for it cancels it, travellers are entitled to a refund and, where applicable, compensation.
- Travellers may terminate the contract without paying a termination fee before the start of the package in exceptional circumstances, for example in the event of serious security problems at the destination that are likely to affect the package.
- In addition, travellers may terminate the contract at any time before the start of the package by paying an appropriate and justifiable termination fee.
- If, after the start of the package tour, it is not possible to provide significant elements of the tour as agreed, suitable alternatives must be offered to the traveller at no extra cost. The traveller may terminate the package tour contract without paying a termination fee if the services are not performed in accordance with the contract, this non-compliance significantly affects the performance of the package tour and the organiser does not remedy this non-compliance;
- Travellers are also entitled to a price reduction and/or compensation for damages in the event of non-performance or poor performance of travel services;
- The organiser must provide assistance if a traveller is in difficulty;
- If the organiser or retailer is declared insolvent, payments will be refunded. If the organiser or retailer is declared insolvent after the start of the package tour and if transport is included in the package tour, the repatriation of travellers is guaranteed.
Direct Book - Agência de Viagens, Lda. has taken out insolvency protection with the Travel and Tourism Guarantee Fund.
